Introduction
Jasmine’s Home is designated a “Residential Facility Class 2,” which is defined by Ohio Mental Health and Addiction Services (OMHAS) as a residential care facility licensed by OMHAS for the purpose of providing accommodations, supervision, and personal care services to 3-5 unrelated adults. Residents of these facilities typically require 24-hour level of support and assistance with daily living skills. The residents of such homes are individuals who, without this level of support, would be homeless, inappropriately residing in nursing homes, have extended hospital stays. Residential Facility Class 2 license operates after complying with the statutory requirements prescribed in the Ohio Revised Code and the rules set forth in Ohio Administrative Code. I. Statement of Permissive Operation
Any person may operate a residential facility providing accommodations and personal care services for one to five unrelated persons and licensed as a residential facility that meets the criteria specified use in any residential district or zone, including any single-family residential district or zone of any political subdivision. Such facilities may be required to comply with area, height, yard, and architectural compatibility requirements that are uniformly imposed upon all single-family residences with the district or zone. II. Anti-Discrimination Statement
The Ohio and Federal Fair Housing Acts protect the operation of Jasmine’s Home as a Residential Facility Class 2. It is the policy and mission of the state and federal anti- discrimination laws to prohibit intentional or unintentional discrimination based on race, color, sex, national origin, religion, disability, and familial status. See R.C. § 4112 et seq., 42 U.S.C. §§ 3601-19.
III. Perrysburg Township Zoning Resolution
Residential Facilities are identified as an interest for the Perrysburg Township Zoning Resolution. As such, the Township manifested an intent to provide for the assimilation of these homes in stable and suitable neighborhoods so that the living environment of their residents are conducive to their rehabilitation. Jasmine’s Home complies with all listed criteria under Perrysburg Township’s Zoning Resolution Article VII Section K.
